Abstract

Open Access is a topic that resonates in the area of dissemination of scientific information (scientific publications and research data) for years. Many EU member states have successfully adopted obligations regarding open access few years ago.

European Commission also adopted its principles when implemented open access into the rules of Horizon 2020 framework programme. Through Commission Recommendation of 17 July 2012 on access to and preservation of scientific information, European Commission invited EU member states to implement open access on the national level.

The Research and Development Council reacted on behalf of the Czech Republic in the beginning of 2014 when recommended to the Czech government an adoption of the national open access strategy. Council also recommended to the research organizations and research funding institutions to support open access in the range of their activities.

Partial success has been reached by some research organizations. But there has been no progress regarding the national strategy of open access. Technology Centre ASCR that includes the national point of reference for open access therefore decided to follow up the Council’s recom­mendation and create a platform that will contribute to the implementation of the national strategy of open access in the Czech Republic.

This contribution will deal current state of the preparation of the national strategy of open access and outline possibilities of the future rights and obligations of the subjects concerned.

It will also introduce the rules of open access in Horizon 2020 framework programme that serves as the basis of considered adjustment of open access in the Czech Republic.

Author's professional CV

Jiří Kotouček works at Technology Centre Academy of Sciences of the Czech Republic in the Information for Research Department and he is a national contact point (NCP) for legal issues of the Framework Programme Horizon 2020.

His main areas of specialization are Intellectual Property Law regarding background and results of research projects, open access to scientific information and contractual relationships in international research projects.

He cooperated on publications Open Access to Scientific Information or Intellectual Property in Framework Programme H2020.

Before joining Technology Centre he worked as a legal trainee. He focused on the commercial law and public procurement.

He graduated from Faculty of Law, Masaryk University Brno.
